THE INFORMATION THAT ZENKO MOVE COLLECTS ABOUT YOU
We may collect and process the following information about you:
1. Information that you give us: This is information about you that you give to us by:

  2. Logging exercise or other activity data in our platform

  4. Joining teams or Global Teams within the platform

2. Activity and fitness data:
  1. Data from activities that you upload to Zenko Move via third-party connections (i.e. Strava, Fitbit, Garmin, Apple Health, Google Fit, WHOOP, Peloton) which includes distance, geo-location, speed, start and end time, activity type, and duration. For all third-party connections, you will be asked for specific consent before this data is shared with Zenko Move.
  2. Our Zenko Move app includes features to track precise geolocation data enabling you to track activities directly into your Zenko Move account. This data includes GPS signals, device sensors and cell tower IDs. We collect this type of data if you grant us access to your location. You can always remove our access using your mobile device's settings.
3. Blockchain and wallet data:
  1. Your automatically generated crypto wallet address and associated transaction data on ApeChain
  2. XP earned, Zenko credits accumulated, and digital collectibles received
  3. Records of causes supported and impact generated through your activities
  4. Team participation and Global Team affiliations
4. Personal information may include:
  1. Your name, email address, profile picture, and any other information you choose to share
  2. Information about your relationship with Zenko Move and participation in our platform
  3. Team memberships, challenge participation, and activity preferences
5. Information that the Zenko Move website and mobile application collect about you:
  1. If you visit our website or use our mobile app, it will automatically collect some personal data about you and your usage, including the internet protocol (IP) address used to connect your device to the internet and other information such as your browser type and version, device type, and the pages or features you access

THE USES THAT ZENKO MOVE MAKES OF YOUR PERSONAL DATA
We may use your personal data for the following purposes, and may from time to time, review information about you held in our systems – including the contents of and other information related to your communications with us – for compliance and business-protection purposes as described:
1. Platform operation and improvement:
  1. To operate, administer and improve our website, mobile application, and other aspects of the way in which we conduct our operations, in Zenko Move's legitimate interests
  2. To process your activities, calculate XP and Zenko credits, and facilitate cause support
  3. To enable team functionality, Global Team participation, and challenge completion
  4. To issue digital collectibles and manage your blockchain-based rewards
2. Legal compliance and protection:
  1. To comply with our legal and regulatory obligations and bring and defend legal claims. This may include reviews for the purposes of disclosure of information relevant to litigation and/or reviews of records relevant to internal or external regulatory or criminal investigations
  2. To protect Zenko Move's business from fraud, money-laundering, breach of confidence, cyber-attack, theft of proprietary materials and other financial or business crimes - in Zenko Move's legitimate interests
3. Business development and marketing:
  1. To operate, manage, develop and promote our business and our relationships with users, partners, and organizations – for example, for marketing purposes, in Zenko Move's legitimate interests
  2. To communicate with you about new features, challenges, campaigns, and updates to our services
4. Impact and cause support:
  1. To facilitate donations and support for causes you select through your earned Zenko credits
  2. To track and report on the real-world impact generated through user activities
  3. To provide transparency and verification of cause support and environmental/social impact
5. To the extent permitted by applicable law, these reviews of your personal data will be conducted in a reasonable and proportionate way. They may ultimately involve disclosure of your personal data to governmental agencies and litigation counterparties as described below, in compliance with law.
6. Your communications may also occasionally be accessed by persons other than the staff member with whom they are exchanged for ordinary business management purposes (for example, where necessary when a staff member is out of the office or has left Zenko Move).
7. Zenko Move will only process your personal data as necessary so that we can pursue the purposes described above, and then only where we have concluded that our processing does not prejudice you or your privacy in a way that would override Zenko Move's legitimate interest in pursuing those purposes.
8. In exceptional circumstances Zenko Move may also be required by law to disclose or otherwise process your personal data. We will tell you, when we ask you to provide information about yourself, if provision of the requested information is necessary for compliance with a legal obligation or, on the other hand, if it is purely voluntary and there will be no implications if you decline to provide the information. DISCLOSURE AND INTERNATIONAL TRANSFER OF YOUR PERSONAL DATA

  1. To other members of the Zenko ecosystem and related companies
  2. To your teammates within teams or Global Teams you join
  3. To organizations you represent through Global Team participation
  4. To service providers who host our website, mobile application, blockchain infrastructure, or other information technology systems or otherwise hold or process your information on our behalf (including cause organizations and impact verification providers), under strict conditions of confidentiality and security
  5. To blockchain networks (specifically ApeChain) where transaction data is recorded for transparency and verification purposes
  6. To cause organizations and impact partners to facilitate the real-world good supported through your activities
  7. To a person who takes over our business and assets, or relevant parts of them
  8. In exceptional circumstances, to competent regulatory, prosecuting and other governmental agencies, or litigation counterparties, in any country or territory; or where we are required by law to disclose
2. The disclosures referred to above may involve transferring your personal data to another country. If you are dealing with us within the UK, you should be aware that this may include transfers to countries outside the UK, which do not have similarly strict data privacy laws such as those seen in the UK or European Economic Area. Blockchain considerations: Please note that certain data recorded on blockchain networks (such as wallet addresses and transaction records) may be permanently stored and publicly viewable on the blockchain, though this data is pseudonymous and not directly linked to your personal identity without additional information.
RETENTION AND DELETION OF YOUR PERSONAL DATA
1. We intend to keep your personal data accurate and up-to-date. We will delete the personal data that we hold about you in accordance with Zenko Move's retention policies.
2. Note that we may retain some limited information about you even when you delete your account, so that we can maintain records for legal compliance, fraud prevention, and to honor any cause commitments made through your activities.
3. Blockchain data: Data recorded on blockchain networks may persist indefinitely due to the nature of blockchain technology, though this data is pseudonymous and not directly identifiable.
YOUR RIGHTS
1. You have a right of access to the personal data that we hold about you, under data protection law. You can also require any inaccurate personal data relating to you to be corrected or deleted.
2. You can object to our use of your personal data for direct marketing purposes at any time and you may have the right to object to our processing of some or all of your personal data (and require them to be deleted) in some other circumstances.

Introduction
1. Website, Mobile Application and Services
  1. These Terms apply to your use of the Zenko Move website, mobile application, and related services (whether as a registered user or a visitor) provided by Zenko Move ("Zenko Move," "we," "us," or "our").
  2. If you register with Zenko Move, submit content to our platform, use any of our services, create teams, participate in challenges, or use our Move-to-Earn features, these Terms will govern the rights and obligations arising between you and Zenko Move.
  3. Use of Zenko Move includes your accessing, browsing, searching, use of community forums, participation in challenges and campaigns, team creation and management, activity tracking, earning and using XP and Zenko credits, receiving digital collectibles, supporting causes, use of blockchain features, or your registration to use our services.
  4. "Your content" means all works and materials (including without limitation text, graphics, images, audio material, video material, audio-visual material, scripts, software, files, activity data, and profile information) that you submit to Zenko Move for storage or publication on, processing by, or transmission via our platform.
2. Acceptance of Terms - By using Zenko Move, you accept these Terms in full and you agree to comply with these Terms. In the event that you disagree with these Terms or any part of them, you must not use Zenko Move.
3. Minimum Age - You must be at least 16 years of age to use our services. By using our services you agree to these Terms, and you represent and warrant to Zenko Move that you are at least 16 years of age. If you are under the age of 16 then you will require the permission of a parent or guardian.
4. Cookies and Tracking – Zenko Move uses cookies and similar tracking technologies. Through your use of our services or agreement to these Terms, you consent to Zenko Move's use of cookies and tracking in accordance with the terms of our privacy policy and cookie policy
Registration and Accounts
1. You may register for an account with Zenko Move by completing and submitting your registration details. This includes:
  1. Creating your profile and selecting preferences
  2. Connecting third-party fitness applications (optional)
  3. Accepting the automatic creation of a crypto wallet for rewards
  4. Joining or creating teams and Global Teams
2. You must notify Zenko Move in writing immediately if you become aware of any unauthorized use of your account.
3. Zenko Move reserves the right, at any time to:
  1. Suspend your account
  2. Terminate your account and/or
  3. Edit your account details, at any time in Zenko Move's sole discretion
4. You may cancel your account at any time, though some blockchain-recorded data may persist as described in our Privacy Policy.
Content of Zenko Move
1. Zenko Move contains content generated by us, third parties whose content is used under license, and user-generated content. The content provided is for general information and motivation purposes only. It is not set up to provide specific medical or fitness advice on which you should rely solely.
2. ALWAYS SEEK ADVICE FROM YOUR DOCTOR IF YOU HAVE ANY CONCERNS ABOUT YOUR CONDITION OR TREATMENT AND BEFORE TAKING, OR NOT TAKING, ANY ACTION ON THE BASIS OF THE CONTENT ON ZENKO MOVE.
3. For the avoidance of doubt, content posted by users through participation in our community features is distinct from official Zenko Move content. Such content may be a useful support tool but ALWAYS SEEK ADVICE FROM YOUR DOCTOR regarding your particular healthcare and fitness needs.
4. Zenko Move makes reasonable endeavors to update information. However, we make no representations, warranties or guarantees, whether express or implied, that the content is accurate, complete or up-to-date.
5. Zenko Move does not represent or warrant that the information or materials available through our services will meet your particular requirements or needs or that access to, or use of, our services will be uninterrupted or completely secure.
User Login Details and Security
1. If you register for an account, you will be asked to choose login credentials. Your password should be kept confidential.
2. Your user ID must not be liable to mislead and must comply with the content rules. You must not use your account or user ID for or in connection with the impersonation of any person.
3. You are responsible for making all arrangements necessary for you to access Zenko Move (including internet connection, appropriate devices, and compatible browsers or mobile operating systems).
Your License to Use Zenko Move
1. You may:
  1. View and use our website and mobile application
  2. Download our mobile application from official app stores
  3. Track activities and earn XP and Zenko credits
  4. Participate in challenges, campaigns, and team activities
  5. Create and manage teams and Global Teams
  6. Support causes through earned credits
  7. Receive and hold digital collectibles
  8. Use blockchain features including your automatically created wallet
  9. Share Zenko Move communications with others who have consented to receive them
2. Except as expressly permitted above or by other provisions of these Terms, you must not download, save, or redistribute material from Zenko Move without permission.
3. You may link to Zenko Move, provided that you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement where none exists.
4. Prohibited Uses - You agree not to:
  1. Use Zenko Move in any way that causes damage or impairment of performance, availability or accessibility
  2. Use our services in any unlawful, illegal, fraudulent or harmful manner
  3. Transmit any malicious software, viruses, or harmful code
  4. Attack our services via denial-of-service or distributed denial-of-service attacks
  5. Conduct systematic or automated data collection without prior written consent
  6. Use automated or AI means to interact with our services (except for search engine indexing)
  7. Use personal data collected from Zenko Move for direct marketing or unauthorized contact
  8. Manipulate activity data, game the system, or create fraudulent accounts
  9. Interfere with blockchain operations or attempt to manipulate reward systems
  10. Misrepresent your identity, activities, or affiliations
5. You agree to ensure that all information you supply is true, accurate, current, complete and non-misleading.
Activity Tracking and Data Accuracy
1. By using Zenko Move's activity tracking features, you acknowledge that:
  1. Activity data should be accurate and represent genuine physical activity
  2. You are responsible for the accuracy of manually entered data
  3. Third-party fitness app integrations may have varying degrees of accuracy
  4. We reserve the right to verify activity data and remove suspicious or fraudulent entries
  5. Manipulation of activity data for unfair advantage is prohibited
Your Content: Grant of License to Zenko Move
1. You grant to Zenko Move a worldwide, irrevocable, perpetual, non-exclusive, royalty-free license to modify, reproduce, store and, with your specific consent, publish your content on and in relation to our services. All such content will be treated as non-confidential.
2. You grant to Zenko Move the right to sub-license the content publication rights to third parties, in our sole discretion.
3. You grant to Zenko Move the right to bring an action for infringement of the content publication rights.
4. You hereby waive all your moral rights in your content licensed to Zenko Move, to the maximum extent permitted by applicable law.
5. You may edit your content to the extent permitted using the editing functionality made available on our platform.
6. Without prejudice to other rights under these Terms, if you breach any provision in any way, or if we reasonably suspect that you have breached these Terms, we may delete, unpublish or edit any or all of your content.
Your Content: Your Obligations
1. Your content must comply with these Terms and must not:
  1. Be illegal, unlawful, or infringe any person's legal rights
  2. Breach any contractual obligations or intellectual property rights
  3. Infringe privacy rights or data protection legislation

Rewards, XP, and Blockchain Features
1. XP and Zenko Credits
  1. XP is earned through legitimate physical activity and platform engagement
  2. XP can be converted to Zenko credits for supporting causes
  3. We reserve the right to adjust, modify, or recalculate XP and credits
  4. Fraudulent activity may result in forfeiture of earned rewards
2. Digital Collectibles and Blockchain Assets
  1. Digital collectibles are issued on ApeChain blockchain
  2. Blockchain transactions are generally irreversible
  3. We do not guarantee the future value or utility of any digital assets
  4. You are responsible for understanding blockchain technology risks
3. Wallet and Cryptocurrency
  1. A crypto wallet is automatically created for you upon registration
  2. You are responsible for maintaining access to your wallet
  3. We cannot recover lost wallet access credentials
  4. Blockchain transactions may involve network fees
Teams and Global Teams
1. When creating or joining teams:
  1. Team names and descriptions must comply with content standards
  2. You may only create teams for legitimate organizations you represent
  3. We reserve the right to verify team authenticity
  4. Team leaders are responsible for their team's conduct
  5. We may remove or modify teams that violate these Terms
Cause Support and Impact
1. When supporting causes through Zenko credits:
  1. We work with verified cause partners
  2. Impact reporting is based on information from our partners
  3. We cannot guarantee specific outcomes from cause support
  4. Cause selection and impact allocation are subject to availability
Intellectual Property Rights - Zenko Move and its licensors own or control all intellectual property rights in our services and materials. All rights are reserved except as expressly granted in these Terms.
Third-Party Integrations
1. Integration with third-party fitness applications:
  1. Is subject to those services' own terms and policies
  2. May be discontinued at any time
  3. Does not create any partnership or endorsement relationship
  4. May involve data sharing as described in our Privacy Policy
Limited Warranties
1. Zenko Move does not represent or warrant:
  1. The completeness or accuracy of information published
  2. The suitability of information, products, and services for any purpose
  3. That material is up to date or compatible with third-party services
  4. That services will remain available on an uninterrupted basis
  5. The accuracy of activity tracking or reward calculations
2. We reserve the right to suspend, delete, discontinue or alter any or all services at any time without notice, and you will not be entitled to compensation upon discontinuance.
3. To the maximum extent permitted by law, Zenko Move excludes all representations and warranties. Our services are provided on an "as is" basis.
Limitations and Exclusions of Liability
1. Nothing in these Terms will:
  1. Limit or exclude liability for death or personal injury resulting from negligence
  2. Limit or exclude liability for fraud or fraudulent misrepresentation
  3. Limit liability in any way not permitted under applicable law
  4. Exclude liability that may not be excluded under applicable law
2. Subject to the above, Zenko Move will not be liable for any loss or damage arising from:
  1. Use of, or inability to use, our services
  2. Reliance on any content displayed
  3. Any information, products, and services obtained through our platform
  4. Events beyond our reasonable control
  5. Business losses, including loss of profits, income, revenue, or opportunities
  6. Loss or corruption of data, database or software
  7. Viruses or technologically harmful material
  8. Special, indirect or consequential loss or damage
  9. Content of third-party websites linked from our services
Data Protection If you register to use our services, we will collect personal data from you. Your personal data will be held securely in accordance with our Privacy Policy.
Termination
1. In the event of your breach of these Terms, or if we reasonably believe you have breached these Terms, we may:

1. Variation - Zenko Move may revise these Terms from time to time. Revised Terms shall apply from the date of publication, and you waive any right to be notified of or consent to revisions.
2. Assignment - You agree that Zenko Move may assign, transfer, sub-contract or otherwise deal with its rights and obligations under these Terms. You may not assign your rights or obligations without our prior written consent.
3. Severability - If any provision is determined to be unlawful or unenforceable, other provisions will continue in effect. If any provision would be lawful if part were deleted, that part will be deemed deleted.
4. Third Party Rights - These Terms are for Zenko Move's and your benefit and are not intended to benefit any third party.
5. Entire Agreement - These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Zenko Move regarding use of our services.
6. Governing Law and Jurisdiction
  1. These Terms shall be governed by and construed in accordance with English law. Any disputes shall be subject to the exclusive jurisdiction of the courts of England.
  2. If you are accessing Zenko Move from outside the United Kingdom:
    1. We make no representations that content will be suitable for your requirements or that access is permissible or legal
    2. Your use is entirely at your own risk and you are responsible for ensuring compliance with applicable laws
7. Reservation of Rights - Any rights not expressly granted in these Terms are reserved.
